We provide claims management services in respect of personal injury, mortgage, secured loan, motor finance, personal unsecured loans, credit card agreements, mis-selling of Payment Protection Insurance (PPI) and refund of bank charges.
What is the process for making a claim?
We will carry out an initial review to assess the likelihood of a possible claim. This information will then be presented to you. If you wish to proceed with one or more potential claims, you will need to enter into a contract with us for the provision of claims management services in respect of your potential claim(s).
On entering into the contract with us, you will be required to pay a review fee (see below).
We will then request all the relevant documents in relation to a particular claim from the product provider. Once we receive the documentation from the product provider, we will carry out a full assessment of the documentation and will inform you of our opinion as to whether your claim has reasonable prospects of success. If we consider that it does have reasonable prospects of success we will pass your claim to MSB Solicitors, a firm with whom we have a referral relationship, in order for the claims process to begin.
At this stage you will be required to enter into a contract with the solicitor. On signing the documentation prepared by the solicitors, the claim is anticipated to take 6 to 12 months to complete, and should not take longer than 15 months. At all times you have the right to seek advice from alternative sources.
What fees are payable?
The fees payable for the claims management services provided by us cover the work carried out by us prior to a solicitor taking on a claim.
For a review in relation to a personal injury claim there is no charge. For a review in relation to a mortgage, secured loan, motor finance, personal unsecured loans, credit card agreements, missold PPI, the review fee payable will be £300 per review.
Existing clients progressing with a personal injury, mortgage, secured loan, motor finance, personal unsecured loans, credit card agreements, misselling of PPI will be charged a reduced fee of £150 for each additional secured loan, motor finance, personal unsecured loans, credit card agreement or missold PPI.
A document request fee of £10 or £11, dependent on the product, is included in the above fees and will be required to be paid to the provider of the product or card in respect of the subject access/CCA request to be made on your behalf to obtain the documentation in relation to the product or card.
Are there any further costs?
In respect of claims in relation to credit cards, secured loans, personal unsecured loans, motor finance and missold PPI, a successful claim fee will be payable. This success fee is between £500 and £2,000 depending on the total benefit recovered/saved.
In respect of refund of Bank Charges there is no charge if it is part of another product review. Otherwise there is a successful claim fee of 10% of the total benefit that will be payable.
No further fees are payable to us in respect of claims in relation to a mortgage.
Where a claim is passed to a solicitor, in the event of a successful claim the solicitor will endeavor to recover their costs from the product provider. You will not be liable for any such costs which the solicitor is unable to recover. You will not be responsible for any solicitor’s costs if your claim is unsuccessful.
Can I Cancel?
You may cancel the contract between us and you at any time by writing to us.
You have a 14 day "cooling off" period from the date of signature of our Client Agreement within which you may cancel the contract with us and we will refund the fees paid to you in full within 30 days of us receiving notice of the cancellation. After this 14 day period, if you cancel the contract with us, you will not be entitled to the refund of any fees paid to us.
Referral fees
If you have been referred to GAJ Associates then the referrer will be paid commission. Where we refer a potential claim to the nominated firm of solicitors referred to above we will receive a referral fee.
Complaints
Our aim is to provide a first class professional and confidential service. We have internal procedures for handling complaints fairly and speedily and, should a complaint arise, in the first instance you should contact our customer services department at the above address.
